The practice of Elder Law involves long range planning as well as immediate crisis planning.
Long Range Planning
Long range planning includes: retirement planning and asset preservation in the event of a catastrophic illness; estate tax planning; probate avoidance planning; and asset management due to incapacity. We handle basic estate planning such as a Last Will and Testament, Health Care Proxy and Power of Attorney, along with more advanced planning including Revocable and Irrevocable Trusts.
Immediate Crisis Planning
Immediate crisis planning takes effect when someone becomes ill and their life savings stands to be quickly depleted. Depending on your situation, we will advise you of various asset preservation options. If you require long term care, at home, at an assisted living facility or in a nursing home, our office handles the entire Medicaid application process while advocating to protect family assets. Even if you are already in a nursing home or receiving home care, there are special provisions in the Medicaid laws that permit you to protect all or a portion of your life savings that would otherwise have to be spent. He is a Participating Attorney with the AARP Legal Services Network. Scott E. Koldin Scott E. Koldin graduated Cum Laude from the University of Rochester and the Syracuse University College of Law. He was an Onondaga County Assistant District Attorney and a partner at the law firm of Cambareri, Cambareri & Koldin, LLP prior to joining the Koldin Law Center. Scott was the recipient of the 1991 American Jurisprudence Award in the area of Professional Responsibility from the Syracuse University College of Law. He is a member of the National Academy of Elder Law Attorneys, the Elder Law Section of the New York State Bar Association and the Onondaga County Bar Association. He serves as a Board Member of the Onondaga County Development Corporation. He is acting Judge for the Village of Manlius. He is a Participating Attorney with the AARP Legal Services Network. Mark N. Schulman Mark N. Schulman has been associated with the Koldin Law Center, P.C. for over 15 years. He is a graduate of the University of Rochester and the Western New England College, School of Law. Mark is the recipient of the American Jurisprudence Award in Estate Planning, a member of the NY State and American Bar Associations, a member of the National Academy of Elder Law Attorneys, a member of the Onondaga County Bar Association and a member of the Elder Law and Trust & Estates Sections of the NY State Bar Association. He serves as a member of the Jamesville-Dewitt School District Board of Education and is a past President of Temple Adath Yeshurun. He is a Participating Attorney with the AARP Legal Services Network. Harvey R. Lasner Harvey R. Lasner has been associated with the Koldin Law Center, P.C. for over 18 years. He was formerly the Supervising Administrative Law Judge for the NY State Department of Social Services for 13 years and was an Assistant Attorney General for the State of New York for 4 years. He is a member of the National Academy of Elder Law Attorneys, the New York State and American Bar Associations. He has been a guest speaker for various nursing homes, hospitals and senior advocacy groups throughout NY State. Stephen K. Koldin Stephen K. Koldin has been associated with the Koldin Law Center, P.C. for over 20 years. He is a graduate of the University of Virginia School of Law, a member of the National Academy of Elder Law Attorneys, the Elder Law Section of the New York Bar Association, is Past President of the Board of Directors of Aurora of CNY and currently serves on the Board of Directors of Family-capped. Answer A Power of Attorney authorizes the person(s) you select to pay bills and make business decisions on your behalf when you become incapacitated.
Answer A Health Care Proxy lets the person you select make medical decisions to carry out your wishes when you are so incapacitated you are unable to make them yourself. Answer If you leave an estate valued at more than $30,000, your Will must go through court proceedings called Probate. The cost and delays of Probate can be avoided by various planning techniques including Trusts. Question How is a Trust different from a Will? Answer A Will only takes effect on death and does not protect your assets if you need long term care. A properly created Trust will avoid Probate on death and protect your home and life savings in the event you need long term care. Answer Recent studies of people over age 65 indicate that almost 70% will require some type of long term care. Question Will Medicare pay for long term care? Answer Medicare can cover long term nursing home care under limited conditions for up to a maximum of 100 days. Most people are not covered. The cost of nursing home care in the Syracuse area has reached $9,000 a month. That is over $100,000 a year. Question Can I protect my home and life savings? Answer Yes.
