ONEIDA, MADISON COUNTY -- Matthew Toomath, a prominent city of Oneida businessman, was arrested Friday morning and charged with two felony counts of possession of child pornography and one count of promoting child pornography. State Police said that promoting child pornography is the act of uploading it to the Internet.
"Mr. Toomath possessed and promoted images and videos with children as young as five years old engaged in sexual acts with adults and animals," said Jack Keller from the New York State Police.
Toomath was taken to Oneida City court to be arraigned, though members of the press were barred from entering the arraignment by Oneida City police officers. The police chief said the arraignment was closed because it was after business hours, though by law arraignments are open to the public.
State Police said that more charges against Toomath could be pending.
"This is early in the investigation right now," said Keller. "Our investigators are taking apart his computer trying to verify what's on them, if we have to verify any information but also to see if there's any victims out there."
Toomath owns the popular "Ye Olde Pizza Pub" in Oneida as well as other restaurants and a bar in Central New York. Neighbor Kathy Charette was alarmed by the news and said she wanted to know more about what was happening a few doors down from her house.
"I don't know if he's innocent or guilty but you just never know who your neighbors are," said Charrete. "Since I'm a mother of three, I'd definitely like to know if something is going on."
Toomath is being held on $25,000 cash bail or $50,000 bond. His next court appearance is scheduled for Friday morning.
