Occupy Wall Street protester plans to plead guilty to disorderly conduct

NEW YORK (AP) -- A defense lawyer says an Occupy Wall Street protester plans to plead guilty in a disorderly conduct case that turned into a clash over law enforcement's access to social media postings.

Attorney Martin Stolar said Wednesday that Malcolm Harris intends to plead guilty Friday to disorderly conduct, the only charge against him.

Stolar says a judge is expected to sentence Harris to time served - the hours he was held after his October 2011 arrest.

A call to the judge's chambers wasn't immediately returned. The Manhattan district attorney's office says it hasn't made any plea deal with Harris.

The case drew attention after prosecutors subpoenaed months of Harris' tweets. Harris and Twitter unsuccessfully challenged the demand. Prosecutors got the material.

Stolar says Harris can continue pursuing the issue in court.
