HERKIMER (AP) -- Authorities have released the name of the 47-year-old man who died after being struck by a car while trick-or-treating with his son in a Mohawk Valley community on Halloween night.

State police say Preston Scott was walking on a street in the town of Herkimer, 58 miles east of Syracuse, when he was hit by a vehicle driven by a 19-year-old Utica woman.

Family members said Scott was taking his 8-year-old son trick-or-treating when the accident occurred around 6:50 p.m. The relatives said Scott had moved to Herkimer from Utica earlier this year to be closer to his son.

The boy wasn't injured.

Troopers say they don't expect any charges to be filed against the driver.

Mr. Scott was wearing dark clothes and walking in the street with his back to traffic, while it was raining, in a poorly lit rural area. Police have found no evidence that Ms. Zulla was behaving irresponsibly - she does not appear to have been using a cell phone, not under the influence, and she was driving the speed limit.

Sometimes tragedies really are just tragedies. This poor young woman is going to have to live with the consequences of this accident for her entire life. Why don't you cut her a little slack, and wait for more facts before placing blame?

No charges? Why is it young people can be careless and take someones life these days and have nothing to worry about. I'm just a little confused. Parents talk to your young inexperienced drivers. Let them know that they need to be more aware of there surroundings. That anything can happen at any given time and they need to be ready for it. My heart goes out to this man's little boy and family. Another life taken way to early. I know how you feel my father was just hit and killed 2 months ago.
