OSWEGO -- Alan Jones never got the chance to stand in front of Judge Walter Hafner Friday. His sentencing for the strangulation murder of 11-year-old Erin Maxwell was delayed because defense attorney Sal Lanza has allegedly uncovered evidence that the jury deliberations were improper.

Neither Lanza nor Oswego County District Attorney Donald Dodd would discuss the motion to throw out Jones conviction. They said Judge Walter Hafner instructed them not to talk about it, and say the Judge will not release the motion papers to the public. Inside the courtroom, Lanza told the judge that jurors "reached out to him" because they felt Jones was not guilty. Lanza said they told him about "what happened inside the jury room" during deliberations. He said a deposition is included in his motion papers.

When pressed by reporters for further details, Lanza said the judge may have to order a hearing on his motion to toss the verdict and "individuals may have to be subpoenaed." Lanza added, "then the judge will rule whether or not sentencing is even going to take place."

Unless Hafner sets aside the verdict on November 16th, Alan Jones faces a sentence of 25 years to life. He was convicted of strangling Maxwell, who died August 30, 2008. Jones told police she accidentally hanged herself.

On September 24th, after nine hours of deliberations over two days, the jurors told Judge Hafner they could not reach a verdict. After being instructed to resume deliberations anyway, the jurors came back with a guilty verdict just two hours later.

Erin's parents, Lynn and Lindsey Maxwell were not home at the time of her death. They are serving two years each for locking the girl in a home full of animals, garbage and feces.

this scumbag needs to be locked up, like i've been saying ever since i started following this case. it discusts me. GUILTY GUILTY GUILTY. whoever is representing him, you discust me as well. if i was a lawyer, i couldnt ever defend such a dirt bag, who should rot in jail for the rest of his scummy life!!!!!!

I have to commend the previous Fulton post regarding the lynching of the Maxwells . . . . BUT

I cannot get past the original statements from the police and investigators when this guy was smirking when his step-sister was ON THE AUTOPSY TABLE, and expounding on his religious (wiccan) beliefs.

Evil things happened in the Maxwell domain - and under this pigs eyes.

Now the piper is calling for payment . . . and he is no longer smirking.

Justice? In a NY court room? Unlikely, I think. And I believe Mr. Lanza is also playing the legal games.

And I guess I am playing the vengence game . . . but if Erin was my sister . . . or daughter . . . or cousin . . . the world would not be a big enough place for this twisted sister to hide in . . . .

I believe the juror. Mark Dristy apparently had the guts to speak out, where no one else would. Whether or not Jones is guilty or not, and I have my doubts, considering the way the whole trial was handled. I still feel that the people that are truly responsible for that childs death are walking around free. There are so many problems, and corruption in the Oswego County System, that I'm not surprised that Jones was found quilty. Easy way to sweep everything under the rug. This case should have been investigated better, and I applaud Sal Lanza for trying to get to the bottom of what really happened. If that child had been taken out of the house in the first place,I have no doubt that she would still be with us today. Shame on everyone that turned there heads, and there are alot of people that did! We miss you Erin.

This smirking killer needs to be put into the general population in Jamesville or equivalent state lockup.

The boys (and probably girls, for that matter) would kill and eat this molester in short order. Or eat THEN kill. Either way.
