Onondaga County Supreme Court Justice Brian DeJoseph is working to schedule a key hearing in the Jim Boeheim defamation lawsuit for the middle of April. A New York County justice previously scheduled a March 14th hearing on the Motion to Dismiss as presented by lawyers for Boeheim and Syracuse University.
In February Judge DeJoseph ruled the lawsuit, as filed by celebrity lawyer Gloria Allred, should be heard in Syracuse instead of New York City. Bobby Davis and Michael Lang are claiming they were slandered by the Hall of Fame basketball coach when he called them "liars" in reacting to their claims of abuse at the hands of former longtime Syracuse University assistant basketball coach Bernie Fine.
Judge DeJoseph is still waiting to have the complete records related to the case transferred form Manhattan to Syracuse and for the Motion to Dismiss to be filed in Onondaga County.
Thelawsuit was filed against Boeheim and the university after it became clear that Davis and Lang would not have legal recourse against Bernie Fine due to an expiration of the statute of limitations for any claims of abuse when the two men were boys.
