SYRACUSE -- As everyone prepares for the murder trial of Stacey Castor in January, it came out in court Monday that the District Attorney is investigating her private investigator and boyfriend for tampering with evidence.
Castor's attorney, Chuck Keller tried to get the Judge Joseph Fahey to quash a Grand Jury subpoena. It was revealed in court that a Grand Jury will hear testimony into whether private investigator Gabriel Ramos and Castor's boyfriend Michael Ochsner removed a pill bottle from Castor's home on Wetzel Road in the Town of Clay in 2007.
The incident allegedly happened after Sheriff's deputies had already cleared the crime scene. It wasn't until recently that authorities determined the pill bottle may be important evidence. Judge fahey will allow the Grand Jury investigation to proceed.
Stacey Castor is accused of murdering her second husband David Castor in 2005 by poisoning him with anti-freeze. She's also charged with attempting to murder her own daughter, Ashley Wallace through a drug overdose meant to look like a suicide. Officials say Castor tried to pin the murder of her husband on Ashley Wallace. Apparently that pill bottle, which investigators did not uncover when they searched the home in 2007, may play a role in the alleged overdose.
The District Attorney's office is refusing to comment about the Grand Jury probe into Ramos and Ochsner. Judge Fahey has denied a request by Action News for court papers filed in connection with the case.
