State Police Investigator Administered Test To Alan Jones
The hearing into the admissibility of statements in the Erin Maxwell murder case continued Friday in Oswego County Court. Alan Jones is accused of strangling his 11 year old stepsister in a home filled with animals, garbage and feces.
Jones told State Police investigators he discovered Maxwell hanging by a rope in her bedroom in an apparent accident. On the stand was Investigator Paul Olson who administered a polygraph to Jones. Defense attorney Sal Lanza objected to the prosecution's questioning of Olson saying polygraphs are not allowed as evidence in New York State.
Judge Walter Hafner allowed the testimony after Assistant District Attorney Mary Rain said, while the results of the polygraph may not be allowed, Jones answers during questioning were pertinent.
Olson testified that Jones showed no emotion when he was told that Erin Maxwell had died.
Olson did not discuss the results of his polygraph exam, but in his memorandum obtained by Action News, Olson said the polygraph indicated "deception" on the part of Jones when questioned about the circumstance of Maxwell's death.
