ALBANY (AP) -- A man who was just 13 years old when he killed another child has been denied parole for the fifth time.
The state Division of Parole denied Eric Smith's release, telling him his "violent and senseless actions" are of concern to the panel.
In August 1993, Smith lured 4-year-old Derrick Robie into some woods in Savona, a small western New York village. Smith hit the boy with a rock, stuffed a paper towel and a lunch bag in his mouth, then crushed his skull with a 26-pound boulder.
Smith is now 30 and was convicted of second-degree murder in 1994 and sentenced to from nine years to life in prison.
He was last denied parole in 2008. His case will be reviewed again in 2012.
