Case against accused distracted driver may move to new court

SULLIVAN -- The court case against a driver accused in a deadly crash may be moving.

Jason Forshee pleaded not guilty to a charge of driving while ability impaired in Town of Sullivan Court Tuesday afternoon. Investigators say Forshee looked down at his cell phone when he went off Route 5 and hit Lynn Eggert last week while she and her husband were walking a dog. Eggert was killed. Police say Forshee was also on prescription drugs, and had smoked marijuana hours before the crash.

The judge in Sullivan is asking the Madison County Court to move Forshee's case to another court because he has ties to Eggert. It will be up to the next judge whether Forshee will have to enter another plea, or if the not guilty plea will stand.

The judge in Sullivan is also planning to write a letter recommending the next court not accept a guilty plea because of possible grand jury action.

Forshee is currently out on bail.
