SYRACUSE (AP) -- A county judge says state police troopers had no authority to arrest a man for strolling the grounds of the New York State Fair wearing an orange jumpsuit, shackles and a sign that said "Close Guantanamo."
Syracuse activist Edward Kinane was charged with trespassing and disorderly conduct after the stunt in 2008.
The charges were eventually tossed out by a town justice. On Friday, Onondaga County Judge Anthony Aloi upheld that decision to dismiss the case.
In a ruling reported by The Post-Standard, of Syracuse, Aloi said, "This is America and people have the right to voice their opinions about issues critical to this country."
County prosecutors have been trying to get the charges reinstated.
Kinane is 66. He spent seven days in jail after his arrest.
