BENTON, YATES CO. -- A sixth person has died as a result of a very serious crash last week in the Town of Benton, Yates County.

Elva Hershberger, 39, of Jasper, New York died Tuesday afternoon from internal injuries suffered in the crash, according to Yates County Sheriff Ron Spike.

Steven Eldridge was driving the car that tried to speed around a farm tractor before slamming into the van filled with Amish farmers coming in the opposite direction, according to deputies. The van then veered into the path of the tractor and was crushed underneath it.

Spike says Eldridge, of Penn Yan, now faces a sixth count of criminally negligent homicide. He also faces driving while intoxicated and other charges. What other charges should prosecutors levy against Eldridge?

The victims, who ranged in age from 39 to 60, were touring farms in New York's Finger Lakes region on July 19. Ten other people were injured, eight of them Amish.

Information from the Associated Press was used in this report.
