ONONDAGA CO. -- The man who spent more than a decade behind bars for a crime he didn't commit is facing new legal troubles.
Roy Brown, of 6291 Perryville Road in Chittenango, was arraigned in Onondaga County Court this morning on charges of criminal possession of a controlled substance and unlawful possession of marijuana. Brown entered a not guilty plea in court.
Police say Brown was found with a small amount of cocaine and marijuana during a traffic stop last October. They say his passenger had heroin on him at the time.
Brown spent 15 years in state prison for the 1991 murder of Sabina Kulakowski. DNA evidence pointed to another man as the real killer, and Brown was released from prison in 2007.
In court today, the prosecutor said the district attorney's office has no desire to see Brown back in jail and has offered probation. She says they will continue to negotiate with Brown's attorney.
The case is due back in court October 18th.
