Case against Megabus driver moves forward. Is possible plea deal fair to victims?

SYRACUSE -- An Onondaga County judge has ruled that the criminal case against a Megabus driver that crashed into the low railroad bridge on the Onondaga Lake Parkway can move forward.

John Tomaszewski from Yardley, New Jersey was in Onondaga County Court Wednesday morning. Judge Anthony Aloi dismissed a defense motion to throw out the case, ruling that there was enough evidence in the Grand Jury minutes to proceed.

Tomaszewski was behind the wheel on September 11th, 2010 when a double-decker Megabus smashed into the railroad bridge, killing four people and injuring many others.

Prosecutors and the defense are in preliminary discussions looking at possibly striking a deal rather than taking the case to trial. Defense attorney Eric Jeschke says,"I think it is fair to say that we are all of the opinion that this case is on the cusp of criminal liability. I'm going to talk with my client about what he wants to do."

Prosecutors say it's too early to discuss what a deal could consist of.

There are other lawsuits against the driver and Megabus that are pending.
