Socci murder suspect sentenced on unrelated drug charges

AUBURN, CAYUGA CO. -- The Auburn man accused of killing his ex-girlfriend was sentenced today on unrelated drug charges.

David McNamara appeared in Cayuga County Court this morning, where he was sentenced to five years in prison and two years probation.

McNamara pleaded guilty last month to criminal sale of a controlled substance and criminal possession of a forged instrument for falsifying a prescription to get painkiller hydrocodone.

In court, his defense attorney filed a motion to suppress statements to probation officers. McNamara's attorney says prosecutors used those statements to keep him in jail on probation violation, while they investigated the murder of 29-year-old Katie Socci. His attorney asked that all notes from meeting with his probation officer be sealed, so they can't be used in the murder trial. However, the judge denied the motion.

Meanwhile, McNamara is set to stand trial for the death of Socci, his former girlfriend. She disappeared on June 12th, and her body was later found near the Auburn-Fleming nature trail off Dunning Avenue. McNamara has pleaded not guilty in the case. The Onondaga County Medical Examiner says Socci died of asphyxiation.

Prosecutors say they have "admissions" in the case, but won't elaborate.

Socci and McNamara had a 22-month-old daughter together. The child is now being raised by Socci's parents.
