SYRACUSE -- Felony drug charges against Roy Brown have been dismissed by John Brunetti. Brown explained the ruling to CNYcentral's Jim Kenyon. He says the judge ruled that had grounds to stop the car, but did not have enough suspicion to detain the car that led to the discovery of marijuana and heroin.
Surprisingly Brown is disappointed by the decision despite having the charges dropped. He wanted to go to trial to clear his name in court. "I am not a drug dealer for God's sake," said Brown.
The Onondaga County District Attorney's office says they are reviewing the judge's decision. The office has 30 days to decide whether or not to appeal the ruling.
In September Roy Brown was indicted on drug charges by an Onondaga County grand jury. Investigators claimed that in October of 2010, Brown was pulled over, and police officers found drugs in his car. There was a passenger in the car who was also detained.
Brown spent 15 years in state prison for the 1991 murder of Sabina Kulakowski. DNA evidence pointed to another man as the real killer. Brown was released from prison in 2007. Brown won a $2.6 million settelment against New York State for wrongful imprisonment.
