Corrections officer charged with assaulting Marcy inmate

MARCY -- A New York State Corrections Officer is accused of assaulting an inmate.

It happened around 7:30 a.m. on January 15, 2010 in a dining hall at Midstate Correctional Facility on Old River Road in Marcy.

A grand jury recently indicted 51-year-old Michael Wehby, of 171 Bouck Road in Frankfort, on assault and attempted assault charges. He was arraigned on the charges in Oneida County Court.

It stems from a joint investigation by the Oneida County District Attorney's Office, New York State Police, Department of Correctional Services and Supervision Inspector General's Office.

Investigators say Wehby caused head injuries to 45-year-old Jose Rivera, an inmate at the facility.

Wehby was released on his own recognizance and is scheduled to reappear in Oneida County Court on December 1.
