Bobby Davis and Mike Lang are suing Jim Boeheim
NEW YORK CITY -- The two men who are suing Hall of Fame basketball coach Jim Boeheim for defamation appeared on CNN Tuesday night for their first live television interview since the story broke on November 17th.
Bobby Davis said to host Piers Morgan, "Boeheim calling us liars is hurtful."
His step-brother Mike Lang talked about the uncomfortable touching at the hands of Bernie Fine. "He touched me the wrong way," said Lang. "He couldn't be told no."
The two men who grew up in the same neighborhood where Bernie Fine lived appeared on CNN in New York seven hours after the live broadcast of their news conference announcing their defamation lawsuit. Celebrity attorney Gloria Allred joined them during the news conference and on CNN. Allred told Morgan commented on Coach Jim Boeheim's apology that came three weeks after his initial comments about the accusers being liars who are out for money. Allred said it's "too little too late."
The lawsuit filed in New York County does not specify the amount of damages being sought. It does name Jim Boeheim and Syracuse University.
There is another development in the Fine case. Attorneys for Bernie Fine have told Federal Magistrate Judge Andrew Baxter they are not opposed to him unsealing the affidavit that supported the sealed search warrant that allowed law enforcement to search the former coach's home, office, locker and banks. That affidavit is a statement from the third accuser in the case, Zach Tomaselli. He was singled out by Onondaga County District Attorney Bill Fitzpatrick during a news conference last week. Fitzpatrick said he was forwarding excuplatory evidence about Tomaselli's claims to both the U.S. Attorney and Fine's legal counsel.
Federal Magistrate Baxter set a deadline of Wednesday, December 14th, to hear comment on whether he should unseal the supporting materials for the initial search warrant application.
