The attorney representing Bernie Fine accusers Bobby Davis and Mike Lang in a slander suit against basketball coach Jim Boeheim and Syracuse University does not want the case moved to Onondaga County.
Attorney Gloria Allred tells CNYcentral that moving the case to Central New York, would give Boeheim an unfair advantage in Syracuse because, "he is a local hero and the University is a local employer."
Allred and her legal team are now reviewing a motion made by attorney's for Boeheim and Syracuse University which argues the defamation suit should be moved from New York City where it was filed, to Syracuse because all the parties are here in this area.
The defamation lawsuit was filed in December. At the time, Allred explained that Jim Boeheim, basketball head coach of Syracuse University, had seen Fine with Davis countless times. Allred stated that, at no time has Bobby Davis or Mike Lang asked for money in return for their statements. Allred said that Boeheim's comments calling Davis and Lang "liars," are particularly disturbing after his countless opportunities to see Fine with Davis over the years. Although Boeheim came out and apologized for his statements, Allred says that it is not enough, that serious damage has already been done.
The Post Standard reports all the parties involved in this case are due to be heard February 21 before Supreme Court Justice Brian DeJoseph in Syracuse. No matter what the decision about the venue, Allred says, "We have confidence in our clients' case no matter where it is ultimately heard."
