NEW YORK -- Attorneys for Bobby Davis and Michael Lang will ask Onondaga County Justice Brian DeJoseph to allow the defamation lawsuit against Jim Boeheim to proceed in New York City.
At a hearing next Tuesday, Maryann Wang will argue before the judge that Jim Boeheim and Syracuse University are so pervasive and lauded in the Central New York community that her clients would not get a fair hearing.
In a newly filed cross-motion to the Change of Venue request made by Jim Boeheim's legal team, Wang rehashes the legal proceedings over the last two months. She has also added articles obtained through online searches referring to Syracuse University as a major employer and money maker for Central New York. She features several columnists who wrote stinging articles about the Hall of Fame basketball coach's reaction to the allegations against his long time assistant Bernie Fine.
The filings also include a new sworn statement from accuser Bobby Davis. He recounts his claims of abuse against Bernie Fine, but also gives his personal account of how the Syracuse University basketball team is put on a pedestal in Onondaga County.
Judge DeJoseph has scheduled a hearing for Tuesday, February 21st at 10:00 a.m. to consider the Change of Venue request by Boeheim's legal team. They would like the case moved to Syracuse. DeJoseph will now also consider the cross-motion from celebrity lawyer Gloria Allred's legal team.
