LENOX -- A traffic stop leads police to arrest a Clay man who allegedly had open containers of alcohol in his car.
Around 1:13 a.m. Sunday, state police pulled over 40-year-old James VanDyke, of 8462 Partridge Way, along Snell Road near State Route 31 in the Town of Lenox.
Troopers say VanDyke was driving a 2004 Dodge Durango and failed to signal a turn. While interviewing him, police say they spotted open bottles of beer and an open champagne bottle inside the car. Police say VanDyke was drinking them. They say his blood alcohol content was .15 percent. He is charged with DWI, driving with a BAC of .08 percent or greater, consumption of alcohol in a motor vehicle and failure to signal turn.
Police also arrested his passenger, 54-year-old Mirta VanDyke and charged her with unlawful possession of marijuana. Police say she had a smoking pipe with marijuana. She was issued an appearance ticket.
Both suspects are scheduled to appear in the Town of Lenox Court on February 21.
