Testimony in Megabus trial focuses on signs, driver training

ONONDAGA COUNTY COURT -- Testimony has wrapped up for the week in the case of the deadly Megabus crash.

The driver, John Tomaszewski, is charged with four counts of criminally negligent homicide. Four people were killed when the double-decker bus slammed into the low hanging railroad bridge over the Onondaga Lake Parkway in Liverpool.

Wednesday's testimony in Onondaga County Court focused on the warning signs before the bridge, and on training for Megabus drivers.

Tomaszewski's attorney showed pictures of some of the 13 warning signs before the bridge, claiming a glare distorts the view. An accident reconstruction expert testified that the pictures were likely overexposed, and didn't necessarily prove a glare.

The Director of Safety at the Megabus company described to the judge some of the training policies. Drivers must complete more than 50 hours of classroom training and 60-90 hours behind the wheel before driving passengers. Drivers are also trained in height awareness. It is against Megabus company policy for drivers to use any handheld devices. Prosecutors say Tomaszewski was checking his GPS at the time of the crash.

Other testimony mentioned what was going on right before the crash. An investigator testified that there did not appear to be any sudden deceleration before the bus hit the bridge. A witness told the judge the driver "did not perceive the threat of the pending collision."

Tuesday's testimony focused heavily on the warning signs on the Parkway.

Tomaszewski waived his right to a jury trial, which means a judge will be the only one to consider the verdict.

Testimony has been adjourned until Monday because of a witness's availability.
