SYRACUSE -- Syracuse Police say a 10-year-old boy caused the accident that sent him to the hospital.

The child was riding his skateboard on Mary Street Thursday when he was hit by an SUV at the intersection with Lodi Street, not far from Franklin Magnet School. Police say the SUV had the right of way on Lodi street. Police classified the cause as pedestrian error.

The child is listed in critical but stable condition at Upstate University Hospital. His name is not being released because of his age. Police say he did not have protective gear.

No tickets have been issued in the case.
