Appeals Court reinstates indictment in Socci murder

AUBURN -- The man accused of killing the mother of his child has just seen his murder indictment reinstated.

David McNamara petittioned the courts to have the indictment tossed out and a lower court agreed earlier this year. McNamara claimed he was not given the chance to testify in front of the grand jury considering the murder charge against him. Today, the Appellate Division ruled the Cayuga County District Attorney's Office was not required to tell McNamara the case was being heard by a grand jury, which returned a murder indictment.

McNamara is accused of killing his ex-girlfriend, Katie Socci. Prosecutors say she was suffocated on June 14th, 2011, and her body hidden in a shallow grave off a park trail not far from her home in Auburn.
