SYRACUSE -- The notorious Stacey Castor was back in Onondaga County Court Thursday morning, appearing before Judge Joseph Fahey, following a ruling on her appeal.
Recently, the Appellate Division of State Supreme Court, upheld Castor's conviction for the anti-freeze murder of her second husband, David Castor, and the attempted murder of her daughter, Ashley Wallace.
The Court ordered Judge Fahey to hold a hearing on whether Stacey should have been represented by an attorney when she was questioned by a sheriff's investigator in 2007, after David's death.
That hearing has been postponed, because Onondaga County District Attorney Bill Fitzpatrick is appealing that ruling to the state's highest court, the Court of Appeals.
Outside the courtroom Thursday, Fitzpatrick told reporters he's confident he will win the appeal, when the decision from the State Court of Appeals comes down. Fitzpatrick says Stacey Castor was convicted on other evidence, gathered by sheriff's investigators.
Right now, she is serving a sentence of up to life in prison.
Castor's trial gained national attention. She was convicted of killing David with antifreeze and then poisoning her own daughter, in a failed attempt to blame her for the murder of David, as well as the murder of her first husband, Michael Wallace in 2000.
Castor has not been formally charged in the murder of Wallace, who also died of apparent antifreeze poisoning.
She's due back in court before Judge Fahey on January 15. Until then, she'll return to Bedford Hills State Prison.
