Alan Jones back in state prison after resentencing

OSWEGO -- The man who killed 11 year old Erin Maxwell is now back in state prison.

Earlier this week, Alan Jones was resentenced in Oswego County Court.  The judge gave him 5 to 15 years on the manslaughter conviction.

The Appellate Division in Rochester had reduced Jones's conviction from second-degree murder, stating the evidence did not support the charge of depraved indifference to human life.

Jones was held at the Oswego County Jail while he waited for the resentencing and returned to Elmira Correctional yesterday. He could be free in 11 months due to good behavior and time already served.
