Federal appeals court upholds convictions of men sentenced in New Hartford officer’s death

NEW HARTFORD -- A federal appeals court has upheld the convictions of three men sentenced in connection with the death of a New Hartford police officer back in 2006.

Last November, a federal jury convicted the men of conspiracy, robbery and murder in the death of Officer Joseph Corr.

Attorneys for Marion Pegese, Robert Ward and Toussaint Davis had argued there was not sufficient evidence to convict them on charges of murder, interference with interstate commerce by robbery and conspiracy to interfere with interstate commerce by robbery.

A holdup outside Lennon's W.B. Wilcox Jewelry Store in New Hartford on February 27, 2006 later led to the shooting death of Officer Corr.

The three men are currently serving life sentences.

A fourth suspect, Walter Richardson, was killed by U.S. Marshals following a standoff outside Philadelphia the day after Corr died. Police say Richardson fired a single shot that killed Corr during a foot chase.
