Chenango County Judge resigns after Commission serves him with formal disciplinary charges

BAINBRIDGE -- A Chenango County judge resigns from office, after he's served with formal disciplinary charges.

Gary Anderson, a Justice of Bainbridge Town Court, was served with a formal written complaint in September.

The New York State Commission on Judicial Conduct says he violated conduct several times in the way he handled various cases over a seventh month period, between February 2011 and September 2012.

In that time, Anderson allegedly found defendants guilty without a plea, trial, or the opportunity for cross-examination.

The Commission says he allowed and considered unsworn statements and evidence that was not properly admitted to court.

In two cases, he dismissed charges without telling the prosecution, which is required by law. He violated another requirement, by not mechanically recording all proceedings, the Commission says.

It also alleges Anderson engaged in ex parte communications, and inappropriately questioned defendants at arraignment.

Bainbridge is about 30 miles northeast of Binghamton, just off Interstate 88.
