New York to appeal ruling striking down drink ban

NEW YORK (AP) -- New York City Mayor Michael Bloomberg says the city will appeal a judge's ruling that struck down a pioneering ban on big sugary drinks just hours before it was supposed to take effect.

Bloomberg says the judge's decision is "clearly in error."

Manhattan state Supreme Court Justice Milton Tingling wrote that loopholes in the law "effectively defeat the stated purpose" of the rule.

The rule prohibits the sale of soda and other sugary beverages in containers bigger than 16 ounces. It applies at restaurants, sports stadiums, delis and movie theatres, but not at supermarkets or many convenience stores.

The restriction was supposed to start Tuesday.
