A State Supreme Court Justice has ruled in favor of the Jordan-Elbridge Central School District in a lawsuit brought by the former High School principal.
State Supreme Court Justice Donald Greenwood issued the decision, upholding the board’s action of excluding David Zehner from its meetings and other school activities on school grounds, except under certain specified conditions.
The court found Zehner’s rights had not been violated. The court dismissed Zehner’s most recent lawsuit.
“The Board of Education wishes for the public to know that it took the action to exclude Mr. Zehner from its Board meetings and certain other activities, only after careful and thoughtful deliberation,” according to a statement issued to CNY Central today. “The Board of Education is heartened by the decision of Judge Greenwood, which ruled that its action was lawful and within the bounds of its authority.”
Last September, the district announced Zehner was being replaced, but wouldn’t say why.
The district has been widely criticized by district residents over the secrecy surrounding the shakeup involving Zehner and several other administrators and the district treasurer.
Parents and taxpayers have held several meetings, hoping to shed light on issues within the district.
