WATERLOO -- An upstate New York man was formally charged Monday afternoon with leaving the scene of an accident without reporting it.

53 year old John Smith of Waterloo pleaded guilty to the charge.

Seneca County Judge Bender offered 1.5-4.5 years in prison, but he retains the right to change the sentence. The maximum is 7 years.

Smith was remanded to the custody of the Sheriff's Department and will be sentenced on Monday, January 7, 2013.

State police say Smith's pickup truck hit and killed 30 year old Stephen Hiyler in May. Smith left the scene of the accident but his truck was found hours later with front end damage.
