NEW YORK (AP) -- The woman who brought domestic violence allegations against a former top aide of New York Gov. David Paterson says she plans to refile charges in the case.

Sherr-una Booker told WNBC-TV she wants former boyfriend David Johnson to be held criminally responsible for assaulting her in October in their Bronx home.

She filed a police report saying Johnson choked her, threw her against a mirror and tried to rip off her Halloween costume. According to court records, Booker then appeared three times in Family Court, which issued an order of protection that wasn't served.

The case was stopped when Booker didn't return to court Feb. 8, a day after a phone conversation with Paterson. The protection order was dismissed but she could seek to have it reinstated.
