LEE, ONEIDA CO. -- The man shot and wounded by a state trooper after he allegedly pointed a rifle at officers is out of the hospital and now facing felony charges.
41-year-old James Newbill was released from Upstate University Hospital Thursday night and charged with menacing a police officer, a felony.
Trooper Shane Treen and an Oneida County Sheriff's deputy went to a home on Meadow Brook Drive in the rural town of Lee around 10:22 p.m. Tuesday after a report of an armed man acting erratically.
Investigators say Newbill came out of his home, fired once in the air and then started walking toward officers, who ordered him to drop the weapon.
They say Newbill pointed the rifle at Trooper Treen, who fired at Newbill several times with his .223 caliber patrol rifle, hitting the suspect in both hands.
Troopers say Newbill was also involved in a car accident and assault earlier Tuesday. He's accused of ramming into a vehicle on State Route 26, and later forcing his way into a home and attacking the person inside.
Newbill was arraigned in the Town of Lee court and sent to the Oneida County Jail in lieu of $100,000 bail or $500,000 bond.
He is scheduled to re-appear in Lee Town Court on June 29th.
