ONEIDA COUNTY -- The man accused of killing a six-year-old girl could have his fate decided by a judge.
David Trebilcock was supposed to go on trial next month for stabbing Lauren Belius. However, Trebilcock's lawyer is now asking the Oneida County Court for a bench trial instead. That would mean Trebilcock would be tried by a judge, not a 12 person jury.
A court hearing has been scheduled for Wednesday morning to discuss the request.
Trebilcock is charged with second degree murder. Prosecutors say he stabbed the young girl in her bedroom on Primo Avenue in Sherrill last summer. Lauren Belius was the daughter of Trebilcock's girlfriend at the time.
