The battle over eminent domain continues in Syracuse.

Hess lost its appeal in New York State Appellate Court against the Syracuse Industrial Development Agency.

Hess was trying to reverse a lower court ruling giving SIDA the power to take the gas station next to Carousel Center. The appellate court decided the grounds for appeal were not correct.

No one from SIDA could be reached for comment Friday night to see what will happen to the gas station.
