ONEIDA -- A seatbelt violation turned into a DWI stop Tuesday as a Madison County man was arrested for allegedly driving drunk at nearly four times the legal limit.

According to State Police, on Tuesday morning around 11:10 a trooper noticed 53-year-old Garry H. Cullen of Upper Lenox Avenue in Oneida was driving down his street without wearing a seatbelt. The trooper pulled Cullen’s 2002 Ford F150 pickup truck over and allegedly found Cullen to be intoxicated behind the wheel.

Cullen was arrested and taken to the State Police barracks in Oneida, where he allegedly blew a .30% blood alcohol content on a breath test. The legal limit in New York State is .08%.

Cullen has been charged with felony DWI, aggravated DWI with a BAC of .18% or more, and no seatbelt. He was arraigned in Oneida City Court and remanded to the Madison County Jail in lieu of $1,500 cash bail or $2,500 bond. He is scheduled to reappear in the City of Oneida Court at an unspecified later date.
