SYRACUSE -- The New York Civil Liberties Union is speaking out in the wake of a scathing report on the 2010 death of a suspect at the Onondaga County Justice Center jail.

Barrei Gewanter tells CNYcentral's Jim Kenyon that the report by the State Commission of Correction "confirms what we already knew" about the death of Raul Pinet, Jr.

Gewanter says Pinet died as a result of "irresponsible actions" on the part of jail deputies. She also feels Onondaga County D.A. Bill Fitzpatrick should investigate the actions of the deputies in light of this report.

The report from the State Commission of Correction ruled the death a homicide. It cites Pinet's death as caused by "asphyxia during restraint."

This disputes the initial report from the Onondaga County Medical's Examiner's office, which says Pinet died as a result of “cocaine-induced excited delirium”.
