Man hit take to Upstate University for treatment

A homeless sign and a drink bottle, left in front of Syracuse's Regional Market after a pickup hit a man Monday afternoon. Read an eyewitness account.

A man is being treated for head injuries and several broken bones, after being hit by a pickup truck on Park Street, in front of Syracuse's Regional Market. 

It happened just before 2pm and traffic was detoured through the Regional Market. The street was temporarily closed while Syracuse Police investigated and interviewed witnesses.

Police say the victim, 43-year-old Timothy Patterson of Syracuse, was crossing Park Street toward the market from a grassy area under Route 81, where homeless people have been camping. 

Patterson was taken to Upstate Hospital with an apparent head injury, say police.

As police investigated, the shoes, a 'help me I'm homeless' cardboard sign, a drink bottle and the pickup, with front-end damage,  remained in the middle of the road. 

The man driving the pickup truck, 36-year-old Richard Benjamin of Liverpool, sat on a curb with his head in his hands.

Among the eyewitnesses, Rob Plumley, who told us he saw it all from his car, from the intersection at Park Street just south of the Regional Market. 

"There was something wrong with him before he even turned," says Plumley. "He was swerving out of the lane, and when he turned around the corner he wanted to be in my lane, and he got all mad 'cause I was in that lane, and he just floored it.  And he was flyin' down.  I seen the guy crossing the street---he was really slow.  And, uh, I don't know how he couldn't see him.  I was way behind him and I seen him."

Police were at the scene several hours, measuring, interviewing witnesses, and bagging the evidence left in the roadway.

As of Tuesday morning, Patterson is listed in stable condition and has a broken ankle, a broken elbow, and a head laceration.

Police ticketed Benjamin for failure to use due care approaching a pedestrian, and Patterson was ticketed for failure to yield right of way to a motor vehicle.

Both will appear in City of Syracuse Traffic Court at a later date.
