Man shooting from a sleeping bag charged with attempted murder

AVA, ONEIDA COUNTY --

Police arrested a man for attempted murder after he shot at three people from a sleeping bag on his property at 11641 Webster Hill Road in the Town of Ava.

Police say it happened around 6:00am Sunday morning,

Police say Jesse Wilcox, 31, his wife Christy Wilcox, 26, and his step-father Lester Platt, 50, went to look for Jesse’s brother Jared Platt at 25-year-old Albert Nellenbach's residence on Webster Hill Road. Police say Nellenbach and Platt were acquaintances.

They looked around the outside of the house, then left. Police say they returned later and saw Nellenback in a sleeping bag in the tree line of his property. As they walked towards him, Nellenback jumped up and started shooting at them with a .22 caliber rifle.

Jesse Wilcox was hit in the earlobe, elbow and back. Police say he is in stable condition at University Hospital in Syracuse.

Police arrested Nellenbach for felony attempted murder and assault. He was arraigned in the Town of Floyd Court on $50,000 cash / $100,000 bond. He is expected back in court on Thursday, August 30.

The investigation is continuing.
