SYRACUSE -- A Syracuse University basketball star was the center of an investigation by the Onondaga County District Attorney's office. District Attorney Bill Fitzpatrick tells Action News Devendorf is accused of harassing a woman on November 1st. Syracuse Police sent the case to the D.A.'s office for a summons application to charge Devendorf with harassment, which is a violation.
Syracuse Police Sergeant Tom Connellan says police responded to the 900 block of Walnut Avenue at around 3:00am on November 1st. He says a 20 year old woman named Kimberly Smith claimed several people had been kicking her car. According to Sgt. Connellan, Smith told police Devendorf punched her and yelled derogatory slurs at her when she got out of the car. Sgt. Connellan says Devendorf was not on the scene when police arrived, so he was not arrested.
Fitzpatrick says his office interviewed the complainant, Devendorf, and several eyewitnesses. "Based on what I learned," Firstpatrick says, "we made a decision to just let the university handle it. Depending on what happens at the university, it could be resurrected if we have new evidence or a new witness."
Action News contacted Syracuse University. Spokesman Kevin Morrow released this statement:
As a matter of federal law (FERPA) and University policy, we cannot discuss any possible disciplinary matter involving a specific student. Generally speaking, if evidence were presented to the University about a violation of the Code of Student Conduct the matter would be thoroughly investigated and appropriately resolved by the University Judicial System as described in the SU Judicial System Handbook.
