New Hartford Subway employee helped to plan robbery at restaurant, police say

NEW HARTFORD -- Three men were arrested on Tuesday after a six month investigation into a robbery at a Subway restaurant on Commercial Drive in the Town of New Hartford, according to the New Hartford Police.

Investigator Matthew Sica says that police were called to the Subway on May 19 at about 10:00 PM.  An employee at the restaurant, 31-year-old Kevin Cole of Utica, said that a man wearing a mask entered, showed a gun and demanded money.  Cole said that the man ran out the back of the restaurant after taking the cash from the register.

Police say that the investigation determined that Cole helped in planning the robbery and it was carried out with 27-year-old Abege D. Berkley of New York Mills and 39-year-old Ricky C. Cummings of Utica.

All three have been arrested and charged with petit larceny.  Cole was charged with falsifying business records, falsely reporting an incident, and giving a false written statement.

The three were arraigned in the Town of New Hartford Court.
